Jacque Label is a women's clothing store at jacquelabel.com operated by Northline Creative Ltd, a United Kingdom-registered company (registration number 17252506) with its registered office at Office 19309, 182-184 High Street North, East Ham, London, E6 2JA, United Kingdom. In the sections that follow, "we", "us" and "our" mean Jacque Label, and "you" means any visitor, browser or customer of the store. Browsing the site, creating an account or submitting an order means you accept these Terms of Service in full; if you do not accept them, please stop using the site.

These Terms operate together with our Privacy Policy, Shipping Policy, Refund Policy and Payment Policy, each of which is incorporated here by reference.

Access and Account

When you accept these Terms of Service you are confirming one of two things: either you have reached the age of 18, or a parent or legal guardian has given you permission to use this store. You must give information that is truthful, complete and up to date at checkout and in any account you register, and you are responsible for keeping your login details private and for activity carried out under them. Tell us promptly at support@jacquelabel.com if you believe your account has been accessed by someone else. We may refuse service, close an account or restrict access to the site where these Terms are breached or where we reasonably suspect misuse.

Our Products

We describe and photograph our garments as carefully as we can, but colour reproduction varies between screens and we do not warrant that an item will look identical to its images on your device. Fabric composition, sizing guidance and measurements are given in good faith and may be adjusted as suppliers update their specifications. We may change, limit or discontinue any product at any time without notice. Where an item sells out after your order has been placed, we will contact you to offer a substitute, a partial dispatch or a full refund of the unavailable item.

Orders

Submitting an order is an offer to buy; no contract is formed until we send a dispatch confirmation for the item concerned, and an order confirmation email is only an acknowledgement that we have received your request. We may decline or cancel any order in whole or in part, including where payment cannot be verified, where fraud or unauthorised card use is suspected, where a listing carried an error, or where stock is not available. Goods sold through this store are intended for personal use by the buyer and not for commercial resale, and we may limit quantities per customer or per address.

Prices and Billing

All prices are shown in Australian dollars and may be revised at any time before you complete checkout; the price applied to your order is the one displayed when payment is taken. If an item is listed at an obviously incorrect price, we may cancel the affected order and refund any amount already charged rather than supply at that price. You must provide valid, authorised payment and billing details, and you authorise us to charge the total shown at checkout including any shipping charge.

Shipping and Delivery

Orders are dispatched from Asia and delivered within Australia by Australia Post. Delivery windows published on the site are estimates only and are not contractual guarantees; we accept no liability for delay, disruption or additional charges arising once a parcel has been handed to the carrier or presented to customs authorities. Risk in the goods passes to you at the point the parcel is collected by the carrier. Timeframes, carrier details, customs charges and lost-parcel procedures are set out in our Shipping Policy.

Order Cancellation

You may request cancellation of an order within 24 Hrs of placing it by emailing support@jacquelabel.com with your order number, and we will confirm in writing whether the request reached us in time. Because packing begins quickly, cancellations cannot be guaranteed once that window has passed or once the parcel has left our fulfilment partners. Intellectual Property

The Jacque Label name, logo, page layouts, photography, product copy, graphics and underlying code are owned by Northline Creative Ltd or used under licence, and are protected by copyright, trade mark and other laws. You may view and print material from the site for your own personal, non-commercial use only. Copying, republishing, scraping, adapting or using any part of it commercially without our prior written consent is prohibited.

User-Generated Content

If you post a review, photograph, rating or comment through the site or our social channels, you grant us a worldwide, royalty-free, perpetual and transferable licence to use, reproduce, edit for length and display that material in connection with our business. You warrant that the content is your own or that you hold the necessary rights, that it is accurate, and that it does not infringe anyone's rights or breach any law. We are not obliged to publish or retain submissions and may remove anything we consider unlawful, misleading or offensive.

Optional Tools and Third-Party Links

Some features, apps or widgets available through the site are supplied by third parties and are offered "as is" without any monitoring, endorsement or control on our part. Where we link to external websites, we do not vet their content, products or privacy practices and accept no responsibility for them. Our Ecommerce Platform

This store is hosted on the Shopify platform, which supplies the technology that allows us to present our products and take payment online. Every sale is nonetheless a contract between you and Jacque Label, operated by Northline Creative Ltd. Shopify is not the seller of the goods and bears no responsibility for the products, order fulfilment, returns or customer service, all of which rest with us.

Privacy

How we collect, use, store and share personal information — including data passed to payment processors and our fulfilment and delivery partners — is explained in our Privacy Policy. By using this site you consent to the handling of your information as described there. Please read it before placing an order.

Feedback

Suggestions, product ideas, design proposals or other feedback you send us are provided voluntarily and without any expectation of confidentiality or payment. You grant us an unrestricted right to use and act on them in any way, and we are under no obligation to reply, credit you or compensate you. This does not affect your rights over content you post that is covered by the user-generated content section above.

Errors, Inaccuracies and Omissions

Occasionally the site may contain typographical mistakes or information that is incomplete or out of date, whether in a price, a stock level, a description or a delivery estimate. We reserve the right to correct such errors and to cancel or amend any order placed in reliance on inaccurate information, refunding you in full where payment has been taken. Disclaimer of Warranties

Limitation of Liability

To the fullest extent permitted by Australian law, Jacque Label and Northline Creative Ltd, together with our directors, employees, suppliers and fulfilment partners, are not liable for any indirect, incidental, special, consequential or punitive loss, including lost profits, lost data, loss of goodwill or business interruption, arising out of your use of the site or of any product bought through it. Where liability cannot lawfully be excluded, our total liability in connection with any order is limited to the amount you paid for that order. This clause does not limit liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law.

Indemnification

You agree to indemnify, defend and hold harmless Northline Creative Ltd, trading as Jacque Label, along with our officers, employees, agents and partners, against any claim, demand, loss, liability or reasonable legal cost arising from your breach of these Terms or of any document they incorporate. This also covers claims resulting from your violation of any law or of a third party's rights, and from content you submit to the site. We may take control of the defence of any such claim at your cost.

Force Majeure

We are not responsible for any failure or delay in performing our obligations where it results from events beyond our reasonable control. Such events include natural disasters, extreme weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes or labour disputes, border closures, customs or port congestion, carrier and courier network failures, power or telecommunications outages, cyber attacks, and acts or restrictions imposed by government authorities. While such an event continues, our affected obligations are suspended, and we will keep you informed and offer a refund where your order cannot be fulfilled within a reasonable time.

Severability

If a court or competent authority finds any provision of these Terms to be unlawful, void or unenforceable, that provision will be read down to the minimum extent necessary or severed from the Terms. The remaining provisions continue in full effect and remain binding on both parties.

Governing Law and Dispute Resolution

Because we sell to customers in Australia, these Terms and any sale made through jacquelabel.com are governed by Australian law, including the Australian Consumer Law, and you retain the right to bring proceedings in the courts of the Australian state or territory in which you reside. Please contact us first with your order number so we can try to resolve the matter directly; we acknowledge complaints within two business days and aim to conclude them within ten. If we cannot reach an agreement, you may escalate the matter to the consumer protection or fair trading body in your state or territory.

Changes to These Terms

We may revise these Terms of Service from time to time to reflect changes in our operations, our suppliers or the law, and the current version is always published at jacquelabel.com/policies/terms-of-service. Revisions take effect once posted, and the terms that apply to your purchase are those in force on the date your order is placed. Continuing to use the site after an update means you accept the amended Terms.
